Terms of Sale
Effective from: 01.09.2026 Amended: 06.10.2026
1. General provisions
1.1. These Terms of Sale govern the legal relationship between FiilGuud Brands OÜ (registry code 10810444, VAT number EE100724257, address Jõeääre tee 22, Loo alevik, Jõelähtme vald, 74201 Harju County, Estonia, the "Seller") and the person making a purchase through the online shop fiilguud.com (the "Shop") (the "Buyer").
1.2. The Seller holds a notice of economic activity no. KJK056746 registered in the Estonian Register of Economic Activities for the retail sale of alcoholic beverages (field of activity: retail trade).
1.3. By placing an order, the Buyer confirms that they have read and agree to these Terms of Sale and the Privacy Policy.
1.4. The Seller may amend the Terms of Sale by publishing the amended terms on the Shop website. Orders already placed are subject to the terms in force at the time the order was placed.
1.5. These terms apply to orders with a delivery country of Estonia, Latvia, Lithuania, Finland or Sweden. Orders containing alcoholic products with a delivery country of Latvia, Lithuania, Finland or Sweden are fulfilled on a "distance purchase" basis (see section 5.7).
1.6. These Terms of Sale have been drawn up in Estonian and translated into the other languages of the Shop. In the event of any discrepancy between the translations, the Estonian text shall prevail.
2. Products and prices
2.1. Prices of products sold in the Shop are in euros and include Estonian VAT (24%), regardless of the Buyer's delivery country. For products in deposit packaging, the packaging deposit is shown separately.
2.2. The Seller may change prices. Price changes do not apply to orders already paid for.
2.3. Alcoholic beverages may only be sold to persons aged 18 or over. By placing an order, the Buyer confirms their age.
2.4. Products marked "Coming soon" in the Shop cannot be ordered. Submitting the interest form ("Notify me when available") is not an order and does not create any obligation for the Buyer or the Seller to buy or sell.
3. Placing an order and conclusion of the contract
3.1. An order is deemed placed when the Buyer has entered the required details, selected the delivery and payment methods and confirmed the order.
3.2. The contract of sale is deemed concluded when the Buyer has paid for the order. The Seller sends the Buyer an order confirmation by e-mail after the payment has been received.
3.3. The Seller may refuse to fulfil an order if:
- the product is not in stock;
- the Buyer has not verified their age when ordering alcoholic products;
- the delivery country is not among the countries served by the Seller.
In such a case, the Seller shall notify the Buyer without delay and refund the amount paid without undue delay, and in any event no later than 14 days.
4. Payment
4.1. Payment is made through the Shop by bank link, card payment or another payment method offered in the Shop, via the Montonio payment service.
4.2. An order is deemed paid once payment confirmation has been received from the payment service provider.
5. Delivery
5.1. The Seller delivers products to Estonia, Latvia, Lithuania, Finland and Sweden, subject to section 5.7.
5.2. Delivery methods and delivery charges are shown to the Buyer at Checkout before the order is confirmed. The delivery charge applies per parcel.
5.3. The Seller hands the order over to the carrier, or prepares "distance purchase" goods for handover, within 1–2 working days of receiving payment. The estimated delivery time is shown at Checkout and in the order confirmation. Unless otherwise agreed, the goods shall be delivered to the Buyer no later than 30 days after the conclusion of the contract. If the Seller is unable to fulfil the order within this period, the Seller shall notify the Buyer, and the Buyer has the right to withdraw from the contract and receive a refund of the amount paid.
5.4. The risk of accidental loss of or damage to the goods passes to the Buyer when the Buyer or a person designated by the Buyer (other than the carrier chosen by the Seller) takes physical possession of the goods. In winter, we recommend choosing an indoor parcel locker or courier and collecting the parcel from an outdoor parcel locker as soon as possible, as cans may freeze. If the Buyer does not collect the parcel within the carrier's storage period and the parcel is returned to the Seller, the Seller may deduct the cost of the return shipment from the refund.
5.5. Alcoholic products are handed over only to persons of legal age. The carrier has the right to check the recipient's age upon delivery and to refuse handover if the age cannot be verified.
5.6. Delivery of alcohol-free products. All products are delivered to Estonia by a delivery method arranged by the Seller (parcel locker or courier), the options and prices of which are shown at Checkout. The same applies to orders to Latvia, Lithuania, Finland and Sweden if the order does not contain any alcoholic products.
5.7. "Distance purchase": orders containing alcoholic products to Latvia, Lithuania, Finland or Sweden. If the order contains an alcoholic product and the delivery country is Latvia, Lithuania, Finland or Sweden, the Seller does not deliver the goods to those countries. The goods are handed over at the Seller's warehouse in Estonia, and the Buyer arranges collection themselves. The Buyer is informed of this on the product page and at Checkout before payment. In such a case:
a) the price and VAT are as set out in section 2.1;
b) the Buyer chooses the transport company and informs the Seller of its name and the preferred collection time. The Seller does not name or recommend a transport company. After the payment has been received, the Seller sends the Buyer the details needed to arrange collection;
c) the transport contract is concluded between the Buyer and the transport company chosen by the Buyer. The Seller is not a party to that contract and is not responsible for the quality, speed or performance of the transport. The risk of accidental loss of or damage to the goods passes to the Buyer when the goods are handed over to the Buyer or the transport company chosen by the Buyer;
d) the Buyer is responsible for complying with the excise and import requirements applicable in their country of residence (including the quantities permitted for personal use);
e) if the order also contains alcohol-free products, the entire order is handed over as a single consignment in accordance with section 5.7. If the Buyer wishes, alcohol-free products can be ordered as a separate order, which will be delivered in accordance with section 5.6.
5.8. The procedure described in section 5.7 is based on the principle of Council Directive (EU) 2020/262 (the Excise Directive), under which excise goods acquired by a private individual for their own use and transported by them are subject to excise duty in the Member State of acquisition (Estonia).
5.9. Legally, the case described in section 5.7 is a sale of goods in Estonia (delivery term EXW – Ex Works). The Seller's obligation is deemed fulfilled upon handover of the goods to the Buyer or the transport company authorised by the Buyer at the Seller's warehouse in Estonia. The term "distance purchase" is a descriptive commercial term, not a statutory term.
6. Right of withdrawal
6.1. The Buyer has the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period begins on the day on which the Buyer or a person designated by the Buyer (other than the carrier chosen by the Seller) takes physical possession of the goods. For orders delivered in several parcels, the period begins on receipt of the last parcel. For "distance purchases", the period begins on the day on which the Buyer or the transport company chosen by the Buyer collected the goods from the Seller's warehouse.
6.2. To withdraw, the Buyer must send the Seller an unequivocal statement by e-mail to inri@fiilguud.com before the withdrawal period expires. The Buyer may use the model withdrawal form in the annex to these terms, but it is not obligatory.
6.3. The Buyer must return the goods without undue delay and in any event no later than 14 days after sending the withdrawal statement, to Jõeääre tee 22, Loo alevik, Jõelähtme vald, 74201 Harju County, Estonia (or another address agreed with the Seller). The Buyer bears the direct cost of returning the goods. For "distance purchases", the Buyer arranges the return themselves.
6.4. The Seller shall reimburse all payments received from the Buyer, including the deposit and the original delivery charge, without undue delay and in any event no later than 14 days after receiving the withdrawal statement. If the Buyer chose a delivery method more expensive than the least expensive standard delivery offered, the Seller is not required to reimburse the resulting additional cost. The refund is made using the same payment method the Buyer used, unless otherwise agreed. The Seller may withhold the refund until the goods have been received back or the Buyer has supplied evidence of having sent back the goods, whichever is earlier.
6.5. The Buyer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods. For opened or consumed beverages, the diminished value may amount to the full price of the goods.
7. Non-conformity of goods and liability
7.1. The Seller is liable for any lack of conformity of the goods that becomes apparent within 2 years of delivery of the goods to the Buyer. If the lack of conformity becomes apparent within 1 year of delivery, it is presumed to have existed at the time of delivery, unless the Seller proves otherwise.
7.2. The Buyer must notify the Seller of the lack of conformity within 2 months of discovering it, at inri@fiilguud.com, attaching a photo and the order number where possible.
7.3. In the event of non-conforming goods, the Buyer is entitled to demand replacement of the goods, a price reduction or withdrawal from the contract in accordance with the law.
7.4. Products must be stored under the conditions specified by the manufacturer: in a cool place, protected from direct sunlight and freezing. When stored properly, the product retains its properties until the "best before" date marked on the product. The Seller is not liable for any deterioration in quality arising after delivery to the Buyer as a result of improper storage or handling.
7.5. The Seller's liability is limited to the value of the order, except where the law provides otherwise (including in the case of intentional breach or breach caused by gross negligence).
8. Applicable law and dispute resolution
8.1. The contract is governed by Estonian law. This does not deprive the Buyer of the protection afforded by the mandatory provisions of the law of their country of habitual residence.
8.2. Disputes shall be resolved through negotiation. If no agreement is reached, the Buyer may refer the matter to the Consumer Disputes Committee (Consumer Protection and Technical Regulatory Authority, www.ttja.ee) or to a competent court.
8.3. Buyers residing in other European Union countries may also contact the European Consumer Centre in the event of a cross-border dispute (in Estonia www.consumer.ee) or the European Consumer Centre in their country of residence.
